Senior Advocate of Nigeria Monday Ubani has questioned whether a House of Representatives committee has the legal authority to ask INEC to disqualify election candidates whose names have already been published.

His comments challenge the proposed basis for disqualification; they are not a court ruling on the candidates’ eligibility.

Vanguard reported that Ubani questioned whether the Supreme Court’s judgment in INEC v. ZLP and others directed the commission to disqualify the affected candidates.

“A committee letter cannot amend the Electoral Act, create a new power of disqualification, or enlarge the orders of the Supreme Court,” Ubani said, according to Vanguard.

The committee’s request for an audit of party membership registers and the disqualification of candidates absent from those records was reported earlier here. That request did not announce that INEC had already disqualified candidates.
