Court Bars NBC from Sanctioning Broadcasters Over Opinions — Interim Injunction Granted

A Federal High Court in Lagos has granted an interim injunction stopping the National Broadcasting Commission from using its “Formal Notice” directive to sanction, fine, or punish broadcast stations and presenters for expressing opinions on air.

Background: The NBC’s Threat

The case stems from an NBC directive that threatened broadcast stations with sanctions for airing content the commission deemed politically biased. Critics immediately dubbed it a “gag order” — an attempt to silence independent commentary ahead of the 2027 election cycle under the cover of broadcasting regulation.

The Socio-Economic Rights and Accountability Project and the Nigerian Guild of Editors filed the lawsuit in late April, arguing that the NBC’s approach violated constitutional guarantees of freedom of expression and press freedom.

What the Court Ruled

The Federal High Court agreed, at least for now, granting an interim injunction that halts the NBC’s enforcement action. The court order prevents the commission from using the Formal Notice to threaten, sanction or take punitive action against any broadcast station or presenter for the expression of personal opinions.

The ruling does not yet settle the matter permanently — the case will continue — but it provides immediate protection for broadcasters who feared they could be fined or shut down for saying the wrong thing about the government.

Why It Matters

Nigeria has a relatively robust broadcast media, but regulatory pressure from bodies like the NBC has historically been used selectively against outlets that are critical of whoever is in power. This court intervention, at least temporarily, restores some breathing room for journalists and presenters who had been operating under the threat of sanctions.

With 2027 elections approaching and political tensions rising, the ruling could not have come at a more important time.
